By accessing or using BidPilot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
BidPilot is a career planning and bid optimization tool designed for airline pilots. The Service provides seniority tracking, career projections, bid building assistance, and contract reference tools. BidPilot is an independent tool and is not affiliated with, endorsed by, or sponsored by Delta Air Lines, Inc., the Air Line Pilots Association (ALPA), or any other airline or labor organization.
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Subscription and Payment
BidPilot offers free and paid subscription tiers. For paid subscriptions:
- Fees are billed in advance on a monthly basis
- Subscriptions automatically renew unless canceled
- You may cancel at any time; access continues until the end of the billing period
- Refunds are not provided for partial months
- We reserve the right to modify pricing with 30 days notice
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Share your account with others or allow unauthorized access
- Attempt to reverse engineer, decompile, or extract source code
- Scrape, harvest, or collect data from the Service without permission
- Interfere with or disrupt the Service or its infrastructure
- Impersonate any person or entity
6. Data Accuracy Disclaimer
BidPilot strives to provide accurate information, but we cannot guarantee the completeness, accuracy, or timeliness of all data. Seniority data is updated periodically from available sources. Career projections and forecasts are estimates based on historical patterns and should not be relied upon for critical career decisions. Always verify important information with official airline or union sources.
7. No Professional Advice
The Service provides informational tools only and does not constitute financial, career, legal, or professional advice. The AI-powered features provide suggestions based on patterns and rules but may not account for all individual circumstances. Consult appropriate professionals before making significant career or financial decisions.
8. Contract Information Disclaimer
Information about the Pilot Working Agreement (PWA) or other contracts is provided for reference only. For binding interpretations of contract provisions, consult ALPA or refer to the official contract documents. BidPilot is not responsible for any decisions made based on contract information provided through the Service.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by BidPilot and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless BidPilot and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service. Your continued use after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
